Pay Tax on Bartering

Barter is doing a trade for a service or product for another.

The conversation might go "Hey Jim Whadda ya say, I'll work painting your house for that sailboat that you were going to sell."

If it goes down then you've got a barter. Then the IRS might want a cut of the action.

So there are rules - (look below) and it is the way that the IRS gets tax income from people who sometimes really are hoping to avoid getting them involved in the deal.

Parties in similar situations often do the deal " Under the table " as the old phrase goes.

In some places there are markets where people do bartering say for a bushel of corn traded for some baked pies.

Your cousin might trade or a few day's mechanic work fixing cars in your repair garage for an old fixer upper pickup truck that you've got out back.

But then the long arm of the IRS wants to reach out and get in on it.

So the hammer comes down and Uncle Sam wants his pound of flesh.

Here's what the IRS says about barter

1. Organized barter exchanges
A barter exchange functions primarily as the organizer of a marketplace where members buy and sell products and services among themselves.

Whether this activity operates out of a physical office or is internet-based, a barter exchange is generally required to issue Form 1099-B, Proceeds from Broker and Barter Exchange Transactions, annually to their clients or members and to the IRS.

2. Barter income Barter dollars or trade dollars are identical to real dollars for tax reporting purposes.

If you conduct any direct barter – barter for another’s products or services – you must report the fair market value of the products or services you received on your tax return.

3. Tax implications of bartering
Income from bartering is taxable in the year it is performed. Bartering may result in liabilities for income tax, self-employment tax, employment tax or excise tax.

Your barter activities may result in ordinary business income, capital gains or capital losses, or you may have a nondeductible personal loss.

4. How to report
The rules for reporting barter transactions may vary depending on which form of bartering takes place.

Generally, you report this type of business income on Form 1040, Schedule C Profit or Loss from Business, or other business returns such as Form 1065 for Partnerships, Form 1120 for Corporations or Form 1120-S for Small Business Corporations.

Obama wants extension of payroll tax cut

There is a battle going on between GOP and Dems but you knew that. The thing is here that the GOP are likely to cut their nose to spite their face if they disapprove of the extension for the deal.

If some voter wake up they might switch sides in this when they realize they they stand to loose so much.

The Republicans will not allow the President to win any points before the election this year and the Republicans are doing this in spite of the fact that it will hurt millions of middle class and poor, many of whom voted for them.

Like sheep, voters are somehow led to follow a Republican politician who spouts just the right kind of patronizing lies.

If you don't earn more than $250,000 a year you have no business voting for a party that has no interest in your survival.

I checked online first to see if it was a scam and of course didn't click the link that was connected to the words "enter the site".
Below is the scam-mail

In our continuing effort to guarantee that accurate information is being maintained on our systems, as well as to be able to give you better quality of service; INTUIT INC. has partaken in the Internal Revenue Service [IRS] Name and TIN Matching Program.

We have found out, that your name and/or Taxpayer Identification Number, that is specified on your account does not match the data obtained from the Social Security Administration.

In order for INTUIT INC. to update your account, please enter the site.

A List Of Some Non-taxable Income

Here is something I was told by the IRS today.
Although most income you receive is taxable and must be reported on your federal income tax return, there are some instances when income may not be taxable.
The IRS offers the following list of items that do not have to be included as taxable income:

Adoption expense reimbursements for qualifying expenses
Child support payments (those you receive)
Gifts, bequests and inheritances
Workers' compensation benefits (some exceptions may apply; see Publication 525, Taxable and Nontaxable Income)
Meals and lodging for the convenience of your employer
Compensatory damages awarded for physical injury or physical sickness
Welfare benefits
Cash rebates from a dealer or manufacturer

It all sounds like a good idea to me. So I guess I need some serious influx of gifts, inheritances and cash rebates ...yessiree that would make me smile!

Married - Name Change - Notify Social Security

If, due to marriage or divorce, you are using a last name other than the name affiliated with your social security number then you have to tell Social Security right away.

When you file taxes it could become a big problem.
So here is the next move.

Get the new social security card with your new name and keep the old number.

If you adopted your spouses children and they have a name change you should apply for them as well.

If your self employed , and you think you will owe more than $1,000.00 for a quarter in taxes, your Uncle Sam wants his cut up front.
That's right, pay now ! Cough up the dough.

Do it by filing a 1040ES with the payment.

The 1040 ES is the estimated tax form for the IRS.

Go to the IRS 1040ES form page and see the dates for the periods and the filing due dates for each quarter.

If you are a wage earner, during the year you can also submit a new W4 form to your boss.

Fill it out to increase your tax amount that is withheld.

Don't Forget Your Earned Income Tax Credit

Take the earned income tax credit!

Depending on your income and if you have one or more children you could qualify for the earned income tax credit.

Don't miss out on this money from the government.

Lot's of people don't look into it and come tax time they get screwed.

For the 2011 tax year the limit is $3,050 for one child and the maximum of $5,666 for three children.

It is simple enough remind your tax preparer to be sure to look into it otherwise you lose.

Didn't get an IRS W2 Form Yet?

No W2 form yet?

Did your employer fail to send you an IRS W2 form yet?

You do know that it is no excuse for not filing on time.

You should get on his/her case and call to let them know.
You don't want to aggravate the IRS.

Maybe your employer or the secretary screwed up but you should have gotten it by February 14, 2012 for tax year 2011.

You can still file with a Form 4852 but it is more of a pain in the butt than filing with the W2 Form in the first place.

In the event that you have to file for an extension read about the handy handy IRS form 4868 for an extension to file.

If you get your W2 form after you filed you will have to file an amended return by filing the 1040X, the amended Individual Tax Return.

Attention Waitresses - IRS says report tips or else

The IRS reminded me today that anyone who works for tips, even the cash ones that go right into your pocket has to report them.

Under the table or over the table you have to pay.

I don't know if they have secret cameras or spies but they figure that you are getting tips and they want their cut on your action.

Reminds me of something Tony Soprano would do.

Here's what they have to say about it all.

"1. Tips are taxable Tips are subject to federal income, Social Security and Medicare taxes. The value of non-cash tips, such as tickets, passes or other items of value, is also considered income and subject to tax.

2. Include tips on your tax return You must include in gross income all cash tips you receive directly from customers, tips added to credit cards, and your share of any tips you receive under a tip-splitting arrangement with fellow employees.

3. Report tips to your employer If you receive $20 or more in tips in any one month, you should report all of your tips to your employer. Your employer is required to withhold federal income, Social Security and Medicare taxes.

4. Keep a running daily log of your tip income. You can use IRS Publication 1244, Employee's Daily Record of Tips and Report to Employer, to record your tip income."

If you have been a slave recently

traffickers then you are to be paid a restitution from the convicted traffickers.

That is of course if they caught them and they can pay restitution.

The convicted human trafficker has to compensate the victim for costs for medical services, physical and occupational therapy or rehabilitation, transportation, temporary housing, child care expenses, lost income, attorneys’ fees and other costs, and other losses the victim suffers as a proximate result of the offense."

The big tax break!

If you have been such a slave of human traffickers then the money that you receive from the trafficker is excluded from gross income for federal income tax purposes.

Scams - Fake IRS Emails etc.

The IRS recently addressed phishing and scams so I though I'd share this info with you.

The IRS gets loads of reports each year from people who get odd emails, faxes, and/or phone calls, claiming to be from the IRS.

A lot of them use the IRS name or logo to make it look real.
The scam is that they are trying to get you to give them your social-security number, bank account info etc. to steal your identity or your money.

The IRS never asks for detailed personal and financial information like PIN numbers, passwords or similar secret access information for credit card, bank or other financial accounts.
The IRS will never contact you by email to request personal or financial information.

So, if you get something like that, do not respond and don't open any attachments because that is an easy way for them to infect your computer.Don't click any links. If you think you may have done just that already go to www.IRS.gov and do a search for "identity theft".
Two things to do

1 Contact the IRS at 1-800-829-1040 to determine if the IRS has a legitimate need to contact you.
   You should report any phoney correspondence.
2 Take the time to forward suspicious email to phishing@irs.gov.
   You can help everyone out here and save other people from being victims

Little Known Medical Treatment Mileage Deduction.

If you know anyone who has been driving a car to bring themselves, their spouse or a dependent for medical treatment they can claim a deduction on their taxes.

A perfect example is the family member who has to travel several miles a week for dialysis or cancer treatments.
These miles add up and they are deductible.

For 2011 you can deduct $0.19 per mile through the end of June but it increases to $0.235 per mile (23 and a half cents per mile) after that until the end of the year.

Per hundred miles it would be $19.00 during the first half of 2011 and $23.50 for the second half of the year. It may seem like a small amount but when you add the miles it is a very worthwhile thing to consider.

Most medical treatments like this are in specialty facilities and often are fifty or a hundred miles away from home.

This can easily add up to thousands of dollars in deductions for some folks.

Many people who are sick are out of work so every cent counts.

Deductions - Do It Before December 31

Charitable Contributions
For those who itemize deductions, make a donation to a qualified charities before the end of the day on Dec. 31, 2011.

It is deductible for 2011.

You will have to have proof such as:

canceled check

a bank statement

credit card statement
a written statement from the charity, showing the name of the charity and the date and amount of the contribution for all cash donations.

Credit card donations by Dec. 31 are OK. You don't have to pay until sometime in 2012 and it will still count for 2011.

You can't donate junk household items or even clothes unless they are in good although used condition or better to be deductible. You can't get rid of your junk and call it charity.

2012 IRS Mileage Allowance

Some changes, some the same.

Last year, the second half of 2011 that is, the rate was 55.5 cents per mile for the IRS mileage allowance for business miles driven.

It was a split year with the rate change taking place mid-year.

2012 brings back the same $0.55.5

Apparently miles ridden on my camel is not deductible.

The big gamble pays off minus taxes

There are tax laws that concern gambling.

I have yet to figure out why the IRS doesn't set up shop in the casinos.

The casino will deduct taxes on some payouts that are large enough for some gambling methods such as the foolish automatic horse race machine.

My ex-squeeze won $2,000 on it and it doesn't pay out tokens or cash but a ticket.

When she cashed in the ticket she got money withheld for the IRS.

But!!! Now here is the rub; if you play blackjack and win $5,000 you pick up your chips and walk away.

Later you cash them in and no tax withheld! Voila!

Is it a legitimate way to avoid tax?
Nope.
You have to pay tax even if they don't withhold it for you.

Newsletters that actually get there

If you have sent newsletters from your e-mail program it could be that of the 200 you sent only 15 were actually read.

How do you know if they aren't in someones spam folder? Did they just ignore it?

I had this problem until I read something from my e-guru Lisa who mentioned using Aweber.

What is it? Well I'll tell you It is a program that can handle your e-mail and send it out when you want it to go out.

It can tell you before you send it if a spam filter will refuse it so that you can fix anything that causes spam filters to react. This alone is really a good idea.

There are statistics that show who opened the email and who ignored it and if you have ads on the email they can tell if someone clicked on the ad or coupon.

They have really nice professional templates for the newsletter or email notification or whatever you are sending.

If you want t send e-newsletters and email notifications that actually get there use this.

Just take a look at it and decide for yourself. I jumped on the bandwagon the first time I looked at the program because it was the solution to email failure. Go ahead - Aweber

Retirement - Are We Screwed?

Well there is good news and bad news.

First the good news:

Social Security will have a 3.6% payments increase for

year 2012!

The bad news is we are running out of money.

You may have heard the latest stuff about the social security system.

In 2017 Social Security will be in trouble paying out more than is coming in from taxes.

By 2041 our social security funds are in trouble and there will only be enough to pay

78 cents on the dollar to you.

That is as it stands now unless something drastic is done.

Taxes aren't really a form of entertainment but in some cases it feels good to find a trove of information about something that is written in an interesting and/or informative way.

Did you know that there are many different 1040 forms and schedules? Yep... www.1040-Forms.com

Yessiree Bob there are and for different purposes.

Most folks don't have the details unless they work for the IRS or are a tax super-pro.

There are 1040A and schedules for that with instructions.

Find info about the an 1040 Schedule M (Make Work Pay Credit), Schedule SE self employment tax and 1040 X... now that sounds ominous but it is for doing and amended tax return.

When it comes to the X form, you'd be better off getting it right the first time rather than have to file the 1040X but there it is if you need it.

Here is a nice bit of information on the W4 form.

The IRS suggests that you should fill one out every year as long as you are working for someone

who should be taking taxes out of your paycheck.

On www.W4Form.biz there is some great information about the

form and when you should use it - for example, if you have a

change in income.

Take a look there for the information on publication 919 that the

IRS tells you to read and use of your income increases to over $130,000.00 for single or

$180,000.00 for married couple.

There are suggestions on if you should pay quarterly estimated tax even if your employer is taking

out taxes.

2012 Tax Year - Some Good Changes

There are changes already decided upon by the IRS for the 2012 tax year, that means for filing in early 2013.

A lot of deductions are increased due to cost of living.

Not by a lot but every penny counts.

The earned income tax credit is up. That's a good thing.

Personal and dependent exemptions are up.

Tax bracket thresholds are changed for the better.

Sadly, "The additional standard deduction for blind people and senior citizens remains $1,150 for married individuals and $1,450 for singles and heads of household."

The annual deductible amounts for MSA's (Medical Savings Accounts) is higher as well.

There are increases in estate tax exclusions.

Business miles are the higher rate. Things jumped up about 4 and a half cents a mile!

As I had mentioned in a previous blog posting a friend was audited for state taxes and they are riding him hard about his mileage deduction.

The 2011 Mileage deduction is .51 cents a mile.
I had a conversation with a guy recently about how his state department of revenue audited him and really came down hard on his record keeping for mileage.

Use tax accounting Software like Turbo-Tax and do your own e-filing.

People pay hundreds of dollars to file taxes and if you have a simple income situation then do it your self.

If you teach school you can take a deduction of educators expenses.

If you have children in school there are some good deductions for that and best of all if you are a student you have deductions that you can take as well.

There are details on the page about why and for whom the form is used.

You must be an American Citizen or have a Resident Alien ID to use one.

If you have earned income from a source other than your employer who would give you a W-2 form at the end of the year for wages earned, then you most likely will be asked to fill out the W-9 form.

You will later get a 1099 showing the amount of money that you have received that year in payment or income earnings.

The form essentially asks your name address and social security number or tax ID number and what type of income was the source.

As usual I like something for free better than when you have to pay.
Seems logical enough for me.

A W9 form is a request for taxpayer ID number and helps clarify your tax status.
The whole thing sounds complicated but it isn't.

When you look at the 3 pages of instructions you might wonder "Why on earth did they write all of that?"

You will fill out what you need to fill out on the first page and the rest is instructions.

The big W-4 Federal Withholding Form

You might think that the word withholding is spelled with one "H" but the IRS Spells it with two H's.
So much for that.

If your employer doesn't withhold enough moolah when it comes to tax time you might well be screwed and have to cough up a small bundle of money.

The dough that the IRS wants is due on April 15 each year and you shouldn't find it a surprise that Uncle Sam wants his cabbage.
